Definitions and Interpretation
In these terms and conditions, the following expressions bear the meanings assigned to them below and cognate expressions bear corresponding meanings:
- “Cookies” refers to small text files transferred by a web server to, and stored on, your hard drive which help you to navigate the Website as easily as possible.
- “IQ Business Insights or IQBI” refers to the private company, duly registered and incorporated in accordance with the company laws of the Republic of South Africa, with its principle place of business at IQ Business Park, No. 3, Third Avenue, Rivonia, 2128.
- “Information Regulator” refers to the Information Regulator established in terms of section 39 of POPIA.
- “Personal Information” refers to Personal Information as defined in POPIA and/or third party information provided by you pursuant to your use of the Website;
- “POPIA” means the Protection of Personal Information Act No. 4 of 2013, as amended from time to time;
- “Privacy Policy” means this privacy policy, as amended from time to time;
- “Services” refers to the services provided by IQBI from time to time, including the services provided via this Website.
- “User” means any person who enters and utilises this website for whatever reason whatsoever;
- “Website” refers to, and includes any part or element of, https://iqbusiness.net/insights/ and any sub-site or other website used by IQBI from time to time.
Introduction
IQBI respects your privacy and is committed to processing and protecting your Personal Information in a lawful, fair and transparent manner.
This Privacy Policy sets out how IQBI uses and protects any Personal Information given to it electronically by the User and the User’s rights in relation to such Personal Information in accordance with POPIA.
By volunteering personal information to IQBI on any part of the Website or any other manner, the User consents to the use and transfer of such information on the provisions as set out herein. IQBI shall, however, take all reasonable measures to ensure that the User’s Personal Information remains protected and confidential and shall store the User’s Personal Information on the terms required by applicable legislation.
By using the Website and accessing the Services, or disclosing Personal Information to IQBI, you agree to be bound by this Privacy Policy and consent to the processing of your Data as set forth herein. If you do not agree to and accept this Privacy Policy, you should not use the Website or access the Services.
This Privacy Policy relates solely to the Website and the Services. The Website may contain links to websites operated by third parties. IQBI is not responsible for the content provided in respect of such websites and/or the privacy policies of such websites and it is recommended that you refer directly to these third parties regarding their privacy policies before supplying any information to them.
What information is collected?
Your Personal Information is collected either electronically by using cookies or is provided voluntarily, your first and last names, telephone numbers, physical, postal and e-mail addresses.
If you use IQBI to collect a third party’s Personal Information:
- you must ensure that such third party is aware of the disclosure of the Personal Information to IQBI and the provisions of this Privacy Policy;
- you warrant that such third party has consented to the disclosure of that Personal Information to IQBI and this Privacy Policy; and
- you agree that you will be responsible for any such Personal Information disclosed to IQBI and will, upon request, assist IQBI with responding to any requests from such third party, including but not limited to requests to access, delete or otherwise change their Personal Information.
IQBI may store any content provided by the User.
IQBI will not be held responsible for any other User’s use, misuse, or misappropriation of any Personal Information or other information that a User may contribute online.
IQBI may use any volunteered personal information to contact the User in order to seek feedback on the services provided by IQBI. A User’s Personal Information may also be used to protect the rights or property of IQBI and where appropriate, to comply with legal process.
IQBI has implemented generally accepted standards of technology and operational security systems and measures to protect the User’s personal information against loss, misuse, alteration destruction, unlawful access and unauthorised destruction.
The User shall have a right to request the details of their Personal Information held by IQBI in terms of POPIA. Should the User suspect that their Personal Information is incorrect or outdated, the User may contact IQBI for the purpose of correcting, updating or removing such Personal Information.
How IQBI collects Personal Information
The User may provide Personal Information to IQBI when communicating with IQBI and/or utilising its functions and/or services.
IQBI may collect Personal Information from a variety of sources, including, but not limited to directly from the User, and/or Personal Information about the User obtained from other sources, including commercially available sources, such as public databases (where permitted by law). Where possible, the User will be informed about what information is required and what information is voluntary.
We may collect the following information including, but not limited to:
- data concerning the User as an individual, including the User’s full name, telephone numbers, email addresses, location, biometric information, date of birth, physical and postal address, identity number and/or passport number and any other information provided which concerns the User as an individual;
- business related information (such as name, address, telephone numbers, payment arrangements, financial information, etc.), the User’s relationship with that business or organisation (such as owner, partner, director, shareholder, employee, or agent), and the User’s contact details within that business (such as work address, work telephone and mobile numbers, work fax number, and work e-mail address);
- information collected or generated out of any surveys IQBI conducts;
- correspondence, communications and messages, including between the User and IQBI, and between IQBI and third parties; and
- website usage information.
In the event of a User providing Personal Information to IQBI on behalf of an organisation, the User warrants that it is an authorised representative of such organisation and is authorised to provide the Personal Information on behalf of the relevant organisation.
Personal Information will only be collected for lawful purposes in accordance with the requirements contemplated in POPIA and the necessary steps to inform the User of the purpose(s) for which the personal information is collected will be taken.
How IQBI users the User’s Personal Information?
IQBI may use the User’s Personal Information to validate the User as a client, remarketing to the User, marketing upcoming events and services on behalf of selected third parties and recruiting new business. The User is entitled to request that IQBI desists from using the User’s Personal Information for the purposes of marketing, and IQBI will provide the User with the necessary functionality for the User to do so with ease, each time IQBI markets to the User.
IQBI may use the User’s Personal Information to provide services to a User that furnishes IQBI with their personal information; fulfil contractual obligations to which IQBI is a counterparty and/or comply with legal obligations.
Additionally, IQBI may use the User’s Personal Information to meet lawful and legitimate business interests to: provide services requested by the User; attend to and promptly resolve any complaints or concerns relayed; carry out research and analysis in relation to the services; ensure records are kept up to date and accurate; send relevant and appropriate electronic correspondence to Users in order to keep them informed regarding, but not limited to, industry developments; and send relevant and appropriate electronic correspondence to existing and/or potential clients regarding the services offered by IQBI.
IQBI will only process Personal Information for the purpose(s) for which it was collected and made known to the data subject in this Privacy Policy.
Is my information secure?
IQBI uses reasonable technical and organisational measures to secure the integrity of the Personal Information under its control and to prevent the loss of, damage to or unauthorised destruction of your Personal Information and unlawful access to or processing of your Personal Information.
All Personal Information is stored in a secure database. However, the transmission of Personal Information via the internet is at your own risk and IQBI accepts no responsibility or liability for any security breach or in the event your Personal Information is damaged, loss disclosed, copied or modified in any unauthorised manner.
IQBI retrieves your Personal Information and presents it to you through a secure encrypted channel that cannot be viewed by anyone but yourself or parties authorised by you.
IQBI is also committed to protecting your Personal Information offline by ensuring that all of your Personal Information, and not just sensitive information, is restricted to only those employees of IQBI who need it to perform a specific task.
When a significant change in the procession of Personal Information is introduced, IQBI will undertake a data protection impact assessment prior to implementing such change.
IQBI maintains a personal information breach register under the control of its information officer and ensures that its employees remain aware of their responsibilities with regard to breaches of the protection of Personal Information. Where IQBI has reasonable grounds to believe that your Personal Information under its control has been accessed or acquired by an unauthorised person, IQBI will notify you and the Information Regulator without delay in accordance with the requirements of POPIA.
How long does IQBI keep the User’s information for?
The time periods for which IQBI keeps the User’s Personal Information may vary according to the use or purpose attached to the Personal Information. Unless there is a specific legal requirement requiring IQBI to keep the User’s Personal Information, IQBI will not keep it for longer than is deemed necessary for the purpose for which the Personal Information was collected or for which it is to be processed.
Disclosing the User’s Personal Information to third parties
IQBI may provide information to third parties but these statistics will not include any information that could identify the User. IQBI will only disclose, distribute or transfer the User’s Personal Information to third parties on the following basis:
- where IQBI has the User’s permission;
- where IQBI is required to do so by law; or
- where such transfer would otherwise comply with law.
In the event that IQBI provides information to third parties, IQBI will use its best efforts to ensure that those third parties will only use that data exclusively for the purposes of discharging their service obligations. Moreover, IQBI will use its best efforts to ensure that these third parties treat the data as confidential as well as ensuring that requirements for the safeguarding of said information are stipulated in contractual agreements with the third party (if applicable).
The User consents to IQBI using, reviewing, collecting, processing and distributing the Personal Information provided to IQBI for any purposes associated with its objectives.
Sharing the User’s Personal Information cross border
IQBI will only transfer a User’s personal information to third parties in another country in any one or more of the following circumstances:
- the User’s personal information will be adequately protected under the other country’s laws, or an agreement with the third-party recipient; or
- where the transfer is necessary to enter, or perform, under a contract with the User, or a contract with a third party that is in the data subject’s interest; or
- where the User has consented to the transfer; or
- where it is not reasonably practical to obtain consent, and the country to which the information is transferred does not have applicable laws, IQBI will ensure that said third party would at the least, apply security safeguards that IQBI would itself apply to secure the User’s personal information.
What are the User’s rights
The User has the right, at any time, to know whether his/her Personal Information is being stored or processed by IQBI, consult with IQBI as to the contents and rationale for processing of such Personal Information, view and request copies of his/her Personal Information, to verify the accuracy of the Personal Information or to request that the Personal Information be updated, supplemented or corrected, withdraw a previously given consent for the processing or automated processing of the Personal Information, object to the processing of the Personal Information for any and all legitimate reasons, or to ask for the deletion of the Personal Information. Any request pursuant to this clause 10 must be addressed to IQBI’s Information Officer in writing by way of e-mail to the e-mail address below.

When and where does IQBI use cookies?
IQBI allocates cookies amongst other times, from the time that the User lands on the Website, during the registration process for the services, in obtaining IQBI’s services, to make an inquiry and to engage in IQBI’s services. These cookies will hold information collected during the User’s registration and will allow IQBI to recognise the User as a customer and provide the User with the services the User require.
How can the User refuse or opt out of cookies?
Most browsers are set by default to accept cookies automatically, but usually the User can alter the settings of the User’s browser to prevent automatic acceptance and to prompt the User every time a cookie is sent to the User or to allow the User to choose not to receive cookies at all. In these circumstances, however, the User then runs the risk that part of this Website may not work or be fully accessible.
How can the User manage the User’s privacy preferences?

How can the User access their Personal Information?
The User has the right to request, free of charge, confirmation as to whether IQBI holds Personal Information about them. They also have the right to request a copy of the record of Personal Information or a description of the Personal Information held about them.
How can the User correct or delete personal information?
The User can request, where allowed by law, the correction, updating or deletion of the Personal Information held. The User can also request, where allowed by law, the destruction or deletion of a record of Personal Information held. Submission of a request for correction or deletion forms together with the details of the request for correction and deletion procedure can be on the website.
How can the User object to the processing of their information?
In certain circumstances, such as when IQBI processes a User’s information for the legitimate interests of both parties, the User may object to the processing of their Personal Information, unless IQBI is required by law or otherwise, to legitimately process such information. Submission of objection forms together with the details of the objection procedure can be found on the Website.
How can a User withdraw consent?
Where a User has given consent to a particular type of processing, the User may withdraw that consent at any time by contacting IQBI through the following email address: popi@iqbusiness.net.
Children
IQBI does not knowingly store or process Personal Information of persons under the age of 18.

Amendment of this Policy
IQBI reserves the right to amend this Privacy Policy, from time to time. Such amendments shall be effected by way of publication thereof on the Website, and you waive any right you may have to receive specific notice of such amendments.
